1 In the District Court, Rogers County, Case No. CRF-73-1, appellant Jermiah Gonzales, hereinafter referred to as defendant, was charged, tried and convicted for the offense of Unlawful Possession of Marihuana With Intent to Distribute. His punishment was fixed at a term of ten (10) years imprisonment with an additional fine of Five Thousand ($5,000.00) dollars assessed. From said judgment and sentence, defendant has perfected a timely appeal to this Court.
